These Terms of Service ("Terms") govern your use of the website located at [website URL] (the "Site") and any quotes, estimates, products, or services ("Services") offered by [Company Name] ("Company," "we," "us," or "our"), a natural and engineered stone fabrication company located at [business address]. By accessing the Site, requesting a quote, or entering into an agreement with us for fabrication or installation services, you ("Customer," "you") agree to be bound by these Terms.

1. Overview of Services

Austin Granite Direct provides fabrication, and may provide installation, of natural stone, quartz, and other engineered surfacing materials, including but not limited to countertops, vanities, backsplashes, and related architectural stonework ("Products"). The Site may be used to request quotes, browse material selections, schedule consultations, and communicate with our team. The Site itself does not constitute an offer to sell; all sales are subject to a separate signed quote, estimate, or contract ("Order").

2. Quotes and Estimates

2.1 Any pricing, square footage estimate, or material availability shown on the Site or provided informally (by phone, email, or online form) is a non-binding estimate only, based on information available at the time.

2.2 Final pricing is confirmed only after in-person or digital templating of the installation area and written acceptance of a formal quote by both parties.

2.3 Estimates may change due to factors including but not limited to: revised measurements after templating, changes in material selection or availability, additional cutouts, edge profiles, structural support requirements, removal of existing surfaces, or site conditions discovered during templating or installation.

3. Orders, Deposits, and Payment

3.1 An Order is not confirmed until Customer signs the applicable quote/contract and submits the required deposit, currently 50% of the total quoted price unless otherwise stated in writing.

3.2 Remaining balances are due upon completion of installation, unless alternate terms are agreed to in writing.

3.3 Late payments may be subject to a finance charge per month or the maximum permitted by law, whichever is lower.

3.4 Custom-fabricated stone products are made to order. Deposits are non-refundable once material has been cut or fabrication has begun, except as required by applicable law.

4. Material Characteristics and Variation

4.1 Natural stone (granite, marble, quartzite, soapstone, and similar materials) is a product of nature and will exhibit natural variation in color, veining, pattern, and mineral composition. Photographs, samples, and slabs viewed in our showroom or online are representative only and may not exactly match the material ultimately fabricated and installed.

4.2 Engineered surfaces (quartz and similar materials) may also exhibit lot-to-lot variation in shading and pattern.

4.3 Customer acknowledges that natural characteristics such as fissures, pitting, veining, and mineral deposits are inherent to natural stone and are not considered defects.

4.4 Where possible, we encourage Customer to view and approve the actual slab(s) to be used prior to fabrication. Customer's approval of a slab (in person, by photo, or by digital layout) constitutes final acceptance of that material's appearance.

5. Templating, Measurements, and Site Access

5.1 Accurate final pricing and fabrication require in-person templating of the installation area, which Customer must schedule and provide access for.

5.2 Customer is responsible for ensuring the installation site is accessible, cleared of obstructions, and that cabinetry or substructure is properly installed and level prior to templating and installation, unless Company has been separately contracted to perform such work.

5.3 Delays caused by inaccessible sites, incomplete cabinetry, or site conditions not disclosed prior to templating may result in rescheduling and additional charges.

6. Installation

6.1 If installation is included in your Order, our team will schedule a mutually agreed date. Timeframes provided are estimates and not guarantees, as fabrication and installation can be affected by factors outside our control (material availability, weather, site readiness, etc.).

6.2 Removal of existing countertops, plumbing disconnection/reconnection, electrical work, or modifications to cabinetry are only included if explicitly stated in the Order. Additional work outside the original scope may incur additional charges, to be approved by Customer in advance.

6.3 Company is not responsible for pre-existing damage to cabinetry, plumbing, flooring, or walls that is discovered or becomes apparent during removal or installation, though we will notify Customer promptly if such conditions are found.

7. Cancellations and Changes

8.1 Customer may request cancellation of an Order in writing. Cancellations made after templating or fabrication has begun may forfeit all or part of the deposit to cover material and labor costs already incurred.

8.2 Changes to material, dimensions, edge profile, or scope after signed Order acceptance may result in revised pricing and timelines.

8. Limitation of Liability

To the maximum extent permitted by law, Austin Granite Direct's total liability arising from any Order or use of the Site shall not exceed the total amount paid by Customer for the applicable Products or Services. In no event shall Company be liable for indirect, incidental, consequential, or special damages, including loss of use of the premises, arising from the sale, fabrication, or installation of Products.

10. Intellectual Property

All content on the Site — including images, design layouts, logos, and written material — is the property of Austin Granite Direct or its licensors and may not be reproduced or used without written permission.

11. Website Use

You agree not to use the Site to: submit false information, attempt unauthorized access to our systems, upload harmful code, or misuse any quote or contact forms. We may suspend access to the Site for any user who violates these Terms.

13. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised "Last Updated" date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
